Terms of Service & Master Agreement
Binding legal agreement governing user access, platform interactions, virtual currency licensing, and AI disclaimers across all Datr Ecosystem & Kustomcode SaaS web and mobile properties.
Master Terms Sections
1. Mandatory 18+ Age Gate & Criminal Representations
Access to and registration on any Datr Ecosystem or Kustomcode platform is strictly restricted to individuals who are at least 18 years of age (or the age of legal majority in your local jurisdiction).
By creating an account, you explicitly warrant and represent that:
- You have never been convicted of a violent felony, sex offense, or crime of dishonesty.
- You are not required to register as a sex offender with any state, national, or international registry.
- Falsification of age or criminal warranty constitutes immediate breach of contract and subjects the user to instant permanent account termination and statutory law enforcement reporting.
2. Closed-Loop Virtual Credits (GG Coins / Sovereign Tokens)
Kustomcode platforms utilize virtual accounting units known as GG Coins or Sovereign Tokens for micro-transactions, premium features, and in-app interactions.
- •Zero Real-World Monetary Value: Virtual credits represent a limited, non-exclusive, non-transferable, revocable license to access digital features within the platform. Virtual credits have zero fiat currency value and cannot be redeemed, refunded, or cashed out for real currency under any circumstances.
- •Closed-Loop System: Virtual credits cannot be transferred between user accounts or traded on external crypto exchanges, ensuring compliance with Financial Intelligence Centre Act (FICA) regulations and Crypto Asset Service Provider (CASP) licensing exclusions.
3. AI Output & Algorithmic Trading Disclaimer of Warranty
Certain platforms within the ecosystem utilize Artificial Intelligence, automated matchmaking heuristics, and algorithmic trading intelligence modules (e.g. Zume CRM drafting, Alpaca stock integrations, and AI Chaperones).
All AI outputs, automated draft suggestions, match scoring, and trading telemetry are provided strictly on an “AS IS” and “AS AVAILABLE” basis for informational and operational assistance. Kustomcode explicitly disclaims all warranties regarding:
- Specific dating, relationship, or matrimonial success outcomes.
- Financial returns, stock trading profitability, or market performance resulting from automated scripts or AI signals.
4. User Generated Content & Conduct Rules
Users retain ownership of content submitted to the platform but grant Kustomcode a global, royalty-free, non-exclusive license to host, display, and process such content for platform operation.
Prohibited conduct includes harassment, hate speech, automated scraping, unauthorized commercial solicitation, distributing explicit non-consensual media, or attempting to bypass tenant isolation boundaries. Violations trigger immediate account suspension and IP ban.
5. B2B Whitelist Access Controls
Access to enterprise SaaS management portals (including zume.kustomcode.xyz and fleet.kustomcode.xyz) is restricted to whitelisted organization tenants holding active enterprise licenses. Kustomcode reserves the right to suspend API key access or terminate tenant instances in the event of unpaid license fees or SLA breaches.
6. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to any principles of conflicts of law.
Any dispute, controversy, or claim arising out of or relating to this agreement shall be submitted to confidential arbitration in Gauteng, South Africa, administered by the Arbitration Foundation of Southern Africa (AFSA), or escalated to the High Court of South Africa (Gauteng Division).
